As electric vehicles (EVs) gain mainstream traction, a pressing problem has been lurking: what happens to used EV batteries? These massive components have a significant carbon footprint during production and create logistical headaches at their end of life. Colorado’s recent legislation aims to address this issue by shifting the responsibility for collecting and processing unwanted EV batteries from local authorities to automakers.

The math problem of EV battery recycling is complex, with no single national framework in place to handle end-of-life batteries. However, Colorado is taking a bold step forward by setting specific targets for recovering minerals like lithium, nickel, and cobalt – all of which are recyclable but difficult to manage due to their bulkiness and heaviness.

The impact on local communities cannot be overstated. Small salvage yards, already struggling with the costs of storing or shipping these massive batteries, may now have a safety net: automakers will be responsible for collecting and processing unwanted EV batteries. As Norman Wright, owner of Stadium Auto Parts in Commerce City, Colorado, noted, “You have got to do something with these batteries… And what do we do with it?” This legislation acknowledges that the solution lies not with local authorities but with those who created this problem.

By making automakers responsible for collecting and processing end-of-life EV batteries, Colorado’s law creates a more equitable distribution of costs and responsibilities. State Sen. Lisa Cutter, co-sponsor of the bill, succinctly put it: “Producer responsibility means that the people making the trash… have to take responsibility for recycling it and for taking care of end-of-life.” This approach has gained support from environmental groups, auto recyclers, and even automakers – likely due to its less stringent nature compared to the EU’s model.

Colorado’s law is a step in the right direction, but it’s essential to acknowledge that battery production remains the biggest shadow hanging over electric vehicles’ carbon footprint. Despite EVs having lower lifetime emissions than gas cars, making their batteries requires significant energy, water, and mining resources. The International Energy Agency estimates that battery recycling could provide 20 to 30 percent of the required lithium, nickel, and cobalt by 2050 – a crucial step towards reducing new mining and cleaner supply chains.

As other states follow suit with similar legislation, it will be interesting to see how they implement their own solutions. Colorado’s specific recycling targets for critical battery minerals could become a benchmark for the industry as automakers switch to cheaper battery materials that are less profitable to recycle. By 2031, Colorado’s recyclers must recover at least 90 percent of cobalt and nickel in EV batteries, along with 50 percent of lithium – by 2035, this target jumps to 80 percent for lithium.

Colorado’s bold move towards shifting responsibility for end-of-life EV batteries from local authorities to automakers is a crucial step towards mitigating the environmental impact of electric vehicles. As the industry continues to grow and evolve, it’s essential that we address these complex issues proactively – not just reactively. By putting the onus on manufacturers to deal with their own waste, Colorado’s law creates a safety net for local communities and sets a precedent for responsible recycling practices in the EV sector.
